Asylum is available for individuals who are present in the United States, either lawfully or unlawfully, and is used as a way to resolve removal problems or to avoid returning to the country of origin upon the expiration of a temporary visa.
The main issue involved with asylum is whether the applicant would be unable to return to his or her own country on the basis of past persecution or a well-founded fear of persecution based on race, religion, nationality, political opinion or membership in a particular social group.

Apply for Asylum With Our Experienced Lawyers
In order to apply for asylum, an applicant must complete the I-589, Application for Asylum, form. This application may be impacted by an applicant's current immigration status, any ongoing removal proceedings and whether any previous asylum applications have been denied. While it is true in many cases that an applicant needs to apply within one year of entering the U.S., there are many exceptions to this requirement.
After filing your application, there will be an asylum interview, which occurs after you have been fingerprinted and not more than 43 days after the filing date on an application.
