J-1 Exchange Visitors and Foreign Residency Requirements

Nonimmigrant J-1 visa holders who participate in the Exchange Visitor Program are often required to return to their home countries. Waivers of Foreign Residency Requirements

In some cases, individuals with J-1 exchange visas may be eligible to waive the foreign residency requirement. Those circumstances include:

  • A visa holder with a spouse or child who is a citizen or lawful permanent resident and can prove that returning home would impose exceptional hardship on that relative
  • The visa holder cannot return home because he or she would be subject to persecution due to race, religion or political opinion
  • The visa holder is engaged in a project of official interest to a U.S. government agency and that agency requests a waiver on behalf of the immigrant
  • The home country of the visa holder provides a written statement to the director of the Bureau of Consular Affairs stating that it has no objection to a waiver
  • A state of the U.S. sponsors the visa holder to work as a physician in an area where there is a manpower shortage
