J-1 Exchange Visitors and Foreign Residency Requirements
Nonimmigrant J-1 visa holders who participate in the Exchange Visitor Program are often required to return to their home countries. Failing to meet this requirement can have significant consequences, including the inability to reenter the United States. Waivers of Foreign Residency Requirements
In some cases, individuals with J-1 exchange visas may be eligible to waive the foreign residency requirement. Those circumstances include:
- A visa holder with a spouse or child who is a citizen or lawful permanent resident and can prove that returning home would impose exceptional hardship on that relative
- The visa holder cannot return home because he or she would be subject to persecution due to race, religion or political opinion
- The visa holder is engaged in a project of official interest to a U.S. government agency and that agency requests a waiver on behalf of the immigrant
- The home country of the visa holder provides a written statement to the director of the Bureau of Consular Affairs stating that it has no objection to a waiver
- A state of the U.S. sponsors the visa holder to work as a physician in an area where there is a manpower shortage
