National Interest Waiver Green Card Attorneys

A National Interest Waiver (NIW) petition requests that the labor certification requirement is waived in the "national interest of the United States". The NIW falls into the employment-based immigration second preference (EB2) category and allows an employer to waive the pre-requisites of a permanent job offer and approved labor certification.

In order to file for an NIW petition, the candidate with an advanced degree or exceptional ability has to prove that he or she is going to be employed in the area of substantial intrinsic merit to the U.S., that the benefit of the activity will be national in scope and that the requirement of a labor certification will have an adverse affect on the national interest. Since the requirement of having a job offer is waived with an NIW, the applicant, even if he or she has no employer, may file a petition on behalf of himself or herself. Additionally, a U.S. employer may file an NIW immigration application on behalf of an immigrant as well. While a National Interest Waiver petition is pending, it is also possible to file another immigration petition in an appropriate category, including an EB-1 extraordinary ability petition.
