In order to obtain an H-2B visa, a petitioner must establish that there is a condition that has made it necessary to hire foreign workers for temporary employment. These conditions include:
- Peak-load need: Employers may need to hire additional workers on a temporary basis due to a seasonal or short term demand, to perform services or labor that will supplement permanent staff. These temporary additions will not become a part of the business's regular operation.
- Seasonal need: A business that needs additional employees because of a season of the year or an event of a recurring nature, that business may hire additional foreign workers on a temporary basis. It must be specified on the application the period(s) of time in which the help is needed
- One-time occurrence: When a temporary event of short duration has created the need for additional employees, a petitioner may apply for an H-2B visa, provided that those added workers do not become a part of the business's regular operations.
