An employer must show that it tried and failed to recruit any available and qualified worker that was already in the United States. This requirement includes a significant amount of advertising and recruitment in the local geographic area, including newspapers, online employment advertisements and additional notifications.
The employer may not discourage a U.S. citizen, or other Lawful Permanent Resident, from applying for the job and may not inform him or her that a foreign worker already filled the position. Rejections of applications may only be done for lawful and job-related reasons.
