Adjustment of Status vs. Consular Processing

In many cases, the facts and circumstances of the case will dictate which process must be completed.

If you are not currently in the United States, you will need to use consular processing in your foreign country of birth or current residence. Consular processing is often slower than adjustment of status in the United States and may take a substantial amount of time to complete and may require additional bureaucratic hurdles. Careful attention to detail in the preparation and presentation of your application can prevent unnecessary delays or other problems.

Conversely, if you are in the U.S. under a lawful admission and maintain a valid nonimmigrant status at the time of application for adjustment, an AOS may be more advantageous. With an adjustment of status, if you get a decision that is not in your favor, there is an appeal recourse, as well as tools and remedies for speeding the process up.
