Explaining the process and the requirements
We advise clients about the process and what to expect. For example, although there are unlimited visas for immediate relatives of citizens and for immigrants returning to the United States, there are limits on the number of visas distributed in other categories. Some categories receive more applications than there are visas available and it may be several years before your family member is able to come to the United States.
In general, the relatives of citizens are usually able to obtain a K visa and a green card more quickly than the families of permanent legal residents seeking a V visa because of the numbers available. Our attorneys explain this process carefully so that you have a realistic understanding of how long it may take.
We also explain other requirements, such as that the Petition for Alien Relative (Form I-130) and Affidavit of Support accompanying it must be completed by the sponsor. The applicant must provide documents such as passports and birth certificates. Each applicant must have a medical examination performed by a physician selected by the U.S. consulate in the applicant’s home country. The applicant must pay the doctor’s fee as well as the visa fee.
