Adjustment of Status as Extraordinary Relief: What the New Memo Means
In a Policy Memorandum issued on May 22, 2026, USCIS characterized adjustment of status as an “extraordinary relief” that permits applicants to avoid the “ordinary” consular visa process. Through its Policy Memorandum, USCIS instructs its officers to weigh all relevant factors and information in the totality of the circumstances to determine whether a favorable exercise of discretion is warranted or whether the applicant ought to be required to follow the “ordinary” process of applying for an immigrant visa at the consular post abroad.
The Policy Memorandum applies to discretionary adjustment of status cases, including family-based, asylee, Cuban Adjustment Act, and crime victim-based applications, but not to non-discretionary filings such as Nicaraguan Adjustment and Central American Relief Act. In evaluating each case, USCIS may consider negative factors such as status violations, fraud, failure to depart when required, and efforts to bypass consular processing. To overcome these concerns, applicants may need to demonstrate “unusual or even outstanding equities.” Positive factors may include family ties in the United States, long-term lawful presence, community ties, good moral character, and a demonstrated benefit to the United States. Notably, the absence of negative factors alone is not enough to establish sufficient equities.
USCIS has not yet provided sufficient guidance explaining how the policy will be implemented in practice or how it may affect individual cases. As a result, the implications for pending and future matters are not yet clear at this time.
